Spill Center Podcast Series: Environmental Spill Emergencies(July 28, 2014)
(PRWEB) July 28, 2014
Spill Center, a North American leader in environmental spill support dedicated to reducing costs and liability for companies that become spill generators, has launched a new series of Internet podcasts on topics related to releases of hazardous materials and other pollution events requiring cleanup and reporting.
Each podcast focuses on a different aspect of spill preparedness and offers advice on how to effectively manage spills to contain costs and limit potential third-party liability claims related to releases. The free podcasts are conducted by Spill Center President Tom Moses, a former U.S. EPA toxicologist who holds a law degree and certificate of hazardous materials control and emergency response.
Considered a leading authority on environmental regulations and compliance issues in the hazardous materials transportation industry, Moses founded Spill Center in 1990 on the premise that no company will ever have enough spills to get good at managing them efficiently and cost-effectively.
He observed that Spill Center compliance associates deal with environmental releases every day on behalf of clients, routinely completing US DOT Incident Report Forms as part of the companys program of spill-related services for clients. Spill Center files more than 300 reports each month more incident reports for clients than any other organization in the country, he noted.
By managing spills in jurisdictions throughout the country, the company has learned what works and what saves money. Highly efficient systems have been developed for spill response, documentation and reporting as well as nationwide cleanup contractor referrals and disposal resources, said Moses.
Clients rely on Spill Center to provide expertise in spill management and regulatory matters to avoid fines and penalties for non-compliance with local, state, provincial and federal environmental reporting rules and minimize cleanup costs and potential liability, Moses added.
Controlling Spill Costs
In the first Spill Center podcast, Moses discussed controlling costs associated with cleanup, starting with an explanation of strict liability arising from environmental spills. He defined it as legal responsibility without regard to fault.
It doesnt matter if it was an accident and you didnt mean to have a spill, if there is a spill, you are responsible as long as you had care, custody or control of the material spilled, he related. Regardless of who was at fault for the release, strict liability makes the spill generator responsible for paying damages associated with it.
In the podcast, which is posted online along with other recent podcasts in the series, Moses discussed damages associated with spills, which include:
- Costs related to response, reporting, remediation and waste disposal
- Property damage and bodily injury arising from the spill
- Fines and penalties for failing to comply with reporting regulations
- Reimbursement of emergency services
